Acceptance of Terms By accessing or using the Site or Services, you agree to be bound by these Terms and Conditions of Use, as well as any applicable Service Level Agreements (SLAs), Master Services Agreements (MSAs), pilot program agreements, or territory licensing agreements (collectively, the “Terms”). DriveSpi, LLC and its licensing authority, EMC Traffic Solutions, Inc., reserve the right to modify these Terms at any time. Your continued use constitutes acceptance of those changes.

  • Law Enforcement & Government Portals: Access to specialized government or law enforcement portals is strictly restricted to authorized agency personnel. Account credentials may not be shared, and access remains contingent upon active contractual agreements between DriveSpi (or its licensing authority) and the participating municipality or agency.
  • Prohibited Platform Activity: You agree not to: (i) reverse engineer, decompile, or disassemble any portion of the software, analytics pipeline, algorithms, or the DriveSpi Operating System; (ii) bypass authentication mechanisms or security features; (iii) use automated systems, scrapers, or bots to extract platform data without authorization; or (iv) attempt to gain unauthorized access to cloud architecture or multi-tenant infrastructure.
  1. Specific User Responsibilities & Data Privacy

  • Data Privacy & Compliance: DriveSpi maintains administrative, technical, and physical safeguards to protect ingested video, telemetry, and evidence packages. Retention schedules, chain-of-custody protocols, and privacy controls are governed by individual municipal contracts to align with local public records laws and law enforcement evidentiary standards.

  1. Payment, Billing & Evidence Volume Metrics
  • Proprietary Fee & Billing Structures: All payment, billing, and revenue-share structures are proprietary to each contracting municipality and negotiated on an individual contract basis.
  • Minimum Volume Requirements & Terms Adjustment: Financial structures, rate schedules, and volume commitments are established per jurisdiction. Where a contracted municipality fails to purchase or process the agreed-upon minimum volume of verified evidence packets produced by the system, DriveSpi and EMC Traffic Solutions, Inc. reserve the right to adjust, modify, or recalculate applicable rates, fees, and operational terms in accordance with the underlying municipal contract.
  1. Hardware & Sensor Integration
  • Edge Devices & Equipment: Certain Services require integration with hardware, mobile sensor packages, or edge capture units deployed on vehicles (including SUVs) or fixed infrastructure. Equipment provided by DriveSpi or authorized partners remains the property of DriveSpi unless explicitly transferred under a separate agreement.
  • Operational Rules & Deployment: Users interacting with hardware or mobile units must operate in strict compliance with safety standards and guidelines provided by DriveSpi. Unauthorized tampering or modification of deployed sensors is strictly prohibited.
